• Appropriate soil erosion and sediment controls will be used and maintained in effective
operating condition during construction. All exposed soil and other fills will be
permanently stabilized at the earliest practicable date. NHN will also attempt to perform
work during periods of low -flow or no -flow.
• The North Haul Road and fill area will be properly maintained, including maintenance to
ensure public safety and compliance with applicable NWP general conditions.
• The temporary fill material will be removed in its entirety and the affected areas returned
to pre -construction elevations upon completion of mining and reclamation activities north
of Meehan Draw.
• Upon removal of the temporary fill material, the affected areas will be vegetated using
the Dryland Pasture revegetation procedures described in Section 2.05.4(2)(e).
The disturbance to this wetland area will be mitigated as described in NHN's Nationwide
General Permit No. 21 - Surface Coal Mining Activities (Section 404) from the U.S. Army Corp
of Engineers. A copy of the approved Nationwide 21 permit is on file at the New Horizon Mine
office and available for review at the Division's request.
