Although there is currently no application or other <br /> matter pending before the Division that would require consideration of EPRC's letter, we feel <br /> it is important to comment on the letter at this time so it does not become a time-consuming <br /> distraction at some future date. <br /> Climax's December 8th submittal to the Division (the "Reg 41 Submittal") <br /> demonstrated that the Climax Mine is in compliance with the Colorado Water Quality <br /> Control Commission ("WQCC") Regulation 41 containing the Colorado Basic Standards for <br /> Groundwater ("CBSG"), including the CBSG Interim Narrative Standard (collectively <br /> "Reg 41"). The Division had requested Climax to make this Submittal. The Reg 41 <br /> Submittal does not request the Division to set Numeric Protection Limits ("NPLs"), but it is <br /> understood that the Division will consider this information in the future establishment of <br /> NPLs for the Climax Mine. <br /> 4117493_1 <br />
