Environmental Protection Specialist Colorado Department of Natural Resources Division of Reclamation, Mining and Safety Office of Mined Land Reclamation 1313 Sherman Street, Room 215 Denver, Colorado 80202 3 Re: Permit No. M-1980-244; Cripple Creek & Victor Gold Mining Company ("CC&V"); Cresson Project — Lett f intention regarding Amendment 11 Permit boundary modification Dear Mr. Cazier: Following recent discussions between CC&V and the City of Cripple Creek regarding the Amendment 11 permit application, in particular the proposed expansion of the CCMOD and permit boundary, CC&V commits to the following; • Re-aligning the proposed Cresson Project permit boundary to fall nearly entirely on the south side of Poverty Gulch in a subsequent permit amendment application to be submitted to DRMS in 2017 (please see attached figure); and, • Aligning the proposed CCMOD boundary with the above referenced permit boundary in the Amendment 11 application to Teller County in 2017. Enclosed with this letter are two figures denoting the initial boundary submitted within Amendment 11 application and a comparative figure presenting the re-aligned boundary. Through undertaking the action above, CC&V will formally honor the commitment made to the City of Cripple Creek through both the State and County approval processes.
