intended to stabilize the existing mill tailings storage area on the south side of the Golden <br /> Gilpin mill. This project was undertaken by these agencies as part of the EPA Superfund <br /> site work within the Central City/Clear Creek Superfund Study Area remediation, part of <br /> the Comprehensive Environmental Response, Compensation and Liability Act <br /> ("CERCLA"). The work, designed in 2004, was completed in 2008, and may have <br /> addressed some or all of the long-term reclamation of the Golden Gilpin mill tailings <br /> impoundment, which has reportedly not received tailings from the Golden Gilpin mill <br /> while under the DRMS permit or while under ownership by the current owner. The <br /> Completion Report for this remedial action was issued on September 19, 2008. <br /> On July 27, 2010, the site was inspected by the DRMS. The report states that"The post- <br /> mining land use is described as industrial/commercial... All pre-existing structures will <br /> remain after closure... Conditions at the Golden-Gilpin Mill appear mostly unchanged <br /> since the last Division inspection in July 2004... There was no production, dewatering, <br /> or water treatment ongoing at either facility, and there have yet to be tailings deposited <br /> at the mill. "[Emphasis added]At that time, the DRMS estimated that the financial <br /> warranty was inadequate to address"the actual cost to reclaim the site". The DRMS <br /> included an estimate of$13,730 was required to bring the financial warranty to a level <br /> necessary to address the DRMS' concerns, at that time. <br /> On September 10, 2010, the DRMS notified CCCM of its proposed financial warranty <br /> increase of$8,730 (SI-1). <br /> On November 29, 2010, the DRMS notified CCCM of an enforcement action regarding <br /> the proposed increase in financial warranty. [In this correspondence, it appears that the <br /> DRMS inappropriately comingled M1990-041 permit enforcement action with the <br /> M1984-013. These permits, while under common control at that time, were and are <br /> separate permits operated under separate entities.] A due date for correction was set at <br /> May 27, 2011. <br /> Following the enforcement action notification of November 29, 2010,the DRMS <br /> received correspondence from CCCM requesting Temporary Cessation status for the <br /> M1990-041 permit. This Temporary Cessation(TC-1) was approved by the DRMS on <br /> March 8, 2011. No further action was taken regarding the proposed financial warranty <br /> increase (SI-1). <br /> On August 22, 2013, the DRMS inspected the site and issued a report, September 19, <br /> 2013. This report stated"All structures which were existing prior to the issuance of the <br /> Reclamation Permit will remain following reclamation... The Golden Gilpin Mill has not <br /> operated since prior to the issuance of the Reclamation Permit." The DRMS revisited <br /> the financial warranty increase proposed as SI-1 and informed CCCM that it would notify <br /> CCCM of the increase in a separate document. <br /> The permit file reflects that the DRMS recalculated the financial warranty(SI-2) on <br /> September 13, 2013. CCCM was notified of this increase ($15,500) on September 19, <br /> 2013. No removal of any structures was provided for in the DRMS recalculation for SI-1 <br /> or SI-2. <br /> Bates-Hunter Technical Revision(TR-03) Page 5 of 380 <br />
