1 Introduction and Summary <br /> In response to the unilateral and arbitrary modification of the approved reclamation plan <br /> for Colorado Division of Reclamation, Mining and Safety("DRMS" or"Division") <br /> permit M1990-041 and in requiring the Operator, Central City Consolidated Mining <br /> Company, to provide additional financial warranty for the DRMS change to the approved <br /> reclamation plan requiring the removal of the Golden Gilpin mill buildings and the <br /> Mined Land Reclamation Board determination that the Operator has failed to provide the <br /> revised financial warranty necessary for the removal of the buildings,the Operator <br /> hereby submits a Technical Revision to the permit. This Technical Revision (TR-03) <br /> provides confirmation that the Operator's intent is and has always been to leave the <br /> buildings intact and provided for this in the approved permit. Additionally,the current <br /> land use zoning for the buildings and equipment at the site is"Environmental Character <br /> Preservation" as designated by the City of Black Hawk("the City of Mills") in which the <br /> mill site resides. This designation specifically includes such buildings and their intended <br /> uses and as such, provides confirmation to the DRMS that these buildings and equipment <br /> should remain post-reclamation. <br /> The technical revision is intended to confirm and reinstate the original reclamation plan <br /> regarding all structures: "All existing structures will remain after reclamation", and that <br /> all equipment and supplies pertinent to mining and milling shall also remain, in <br /> congruence with the Central City- Black Hawk National Historic District and the City of <br /> Black Hawk's Comprehensive Plan(2004), it's Public Heritage Master Plan (2003)and <br /> current land use zoning. <br /> 2 Background and History <br /> 2.1 Site Location <br /> The site is the Golden Gilpin mill, Colorado Mined Land Reclamation Board Permit M- <br /> 1990-041, located on Colorado Highway 119, within the northern boundary of the City of <br /> Black Hawk. <br /> 2.2 Site History <br /> The site is comprised by land claimed as a millsites in the latter half of the 191h century, <br /> named "Millsite #11" and"Millsite 410". The Mead and Prize mills were established <br /> upon"Millsite 410" sometime between 1870 and 1905 (Sanborn, 1905, attached as <br /> Exhibit B). The Prize mill was"Closed&Dilapidated" as of 1905, with the Mead mill <br /> continuing to process ores. In 1934, the current building was erected upon the Prize mill <br /> site. The Mead mill foundations exist immediately north and west of the current Golden <br /> Gilpin mill building. Mr. George E. Otten, of the Central City Consolidated Mining <br /> Company, acquired the title to the site in 1989. Mr. Otten applied to the DRMS (then the <br /> "Colorado Mined Land Reclamation Division") for a mining permit in 1990. <br /> Bates-Hunter Technical Revision(TR-03) Page 3 of 380 <br />
