The presence of refuse has been documented in previous inspection reports <br /> and the Operator has been afforded numerous opportunities to remove the refuse from <br /> the mine and mill. The cost to remove the refuse, scrap metal and equipment will be <br /> included in the financial warranty calculation.... In absence of documentation from <br /> Gilpin County or the City of Blackhawk demonstrating the mill building is in <br /> conformance with all zoning requirements, the Division will include the cost for <br /> demolition of the building in the bond calculation. As a result, the financial warranty <br /> will increase substantially. " <br /> On June 8, 2016, the DRMS was notified by CCCM that its sole officer, Mr. George E. <br /> Otten, 90 years of age, had suffered a stroke in November of 2015 and provided that <br /> reason as to why previous contact from the DRMS had not been responded to. CCCM <br /> requested additional time to address the issues noted in the report of May 27, 2016. <br /> On July 6, 2016,the DRMS notified CCCM of a financial warranty recalculation and <br /> increase (SI-3). The recalculated increase proposed a financial warranty of$149,721.00 <br /> and included costs associated with the removal of the Golden Gilpin mill building and <br /> associated structures, in contradiction to the stated permit reclamation plan. <br /> On July 18, 2016, CCCM requested an extension to complete corrective actions <br /> associated with the inspection of April 26, 2016. The DRMS notified CCCM's <br /> contractor for the corrective actions by telephone that the extension had been approved. <br /> At that time, Mr. Otten designated Matt Collins, P.E. as an additional contact for all <br /> compliance matters regarding this permit. <br /> On October 14, 2016, the DRMS was notified by CCCM's contractor of substantial <br /> completion of corrective actions. <br /> On October 17, 2016, the DRMS notified CCCM of an enforcement action regarding the <br /> financial warranty increase (SI-3) as provided on July 6, 2016. No notice was provided <br /> to Matt Collins. <br /> On October 20, 2016, the DRMS received the final corrective action report from the <br /> contractor regarding possible violations noted in the April 26, 2016 inspection report. <br /> On October 28, 2016, CCCM was notified by the DRMS that the corrective actions taken <br /> by the contractor were sufficient to abate the possible violations noted in the April 26, <br /> 2016 inspection report. <br /> On November 11, 2016, CCCM responded to the DRMS financial warranty increase (SI- <br /> 3), restating its position that the DRMS was incorrectly determining the amount of <br /> "scrap"and"refuse" at the permitted sites and disputed the unilateral change in <br /> reclamation plan, requiring the demolition and removal of the mill building. CCCM <br /> provided the DRMS with a notarized letter stating the property owner's intent that the <br /> buildings and structures remain. <br /> Bates-Hunter Technical Revision(TR-03) Page 7 of 380 <br />
