11) The Division has updated the reclamation cost estimate associated with the Seneca HWpermit. The updated <br />reclamation cost liability for the Seneca IIW Mine is $4,046,578.00. ........... Seneca Property, LLC <br />currently has a surety bond in the amount of $5,818,456.00. <br />Response: SP currently has a bond reduction request pending with the CDRMS reflecting the difference between <br />the current surety bond and the re-calculated reclamation liability. SP understands that the CDRMS will review <br />the bond liability calculation prior to finalizing the Permit Renewal, and the bond reduction request may be <br />modified accordingly. <br />SP replaced the self-bond with a corporate surety in the amount of $5,818,456.00 on April 1, 2016 On September <br />19, 2016, SP requested a bond reduction based upon the RN6 reclamation cost estimate conducted by the <br />Division. The Division responded SP may request a bond reduction as a TR after the approval ofRN6. <br />Based upon information told to the Division inspector during the fall of 2016, a new landowner has purchased <br />propertyformerly owned by the John Ricks Family Trust. As a result of this information the Division has this <br />additional adequacy concern. <br />12. Please update the surface ownership map, Exhibit 3-1, Tab 3, land owner information, and right of entry <br />agreement with the name and address of the new landowners on the propertyformerly owned by the John Ricks <br />Family Trust. <br />Response 12: Please see previous response 3a. <br />
