5.2 Compliance with Laws. Lessee shall comply with the terms of all
<br />- local, stale, and Federal environmental and reclamation laws, rules, and regulations
<br />pertaining to its operations and to reclamation activities, including, without limitation,
<br />those of the Colorado Mined Land Reclamation Division. Lessee's obligation with
<br />respect to the above - mentioned laws, rules, and regulations, and with respect to the
<br />requirements of this Article, shall survive the termination of this Lease.
<br />ARTICLE VI
<br />ADDITIONAL OBLIGATIONS OF LESSEE
<br />6.7 Conduct of perations. Lessee shall conduct all Mining Operations
<br />in a proper and workmanlike manner, and in accordance with sound coal mining
<br />practices, as such practices exist from time to time, so that the greatest amount of Coal
<br />may be mined or produced from the Unitized Premises with the least amount of waste.
<br />62 Mechanics' Liens. Lessee agrees that, at all places where work is
<br />being performed on the Premises, written or printed notices shall be posted and
<br />maintained in conformance with the laws of the State of Colorado relating to mechanics'
<br />Liens, in order to protect the Premises and the Lessor from any liens for labor performed
<br />on the Premises or for material furnished for Lessee's operations or activities hereunder.
<br />Such notices shall recite that neither Lessor nor the Premises may be held liable for any
<br />claims at any time arising out of Lessee's operations or activities hereunder, including,
<br />but not limited to, the acts of Lessee's employees, agents, and independent contractors.
<br />Lessee shall pay for all materials, services, or labor used or performed on the Premises
<br />promptly as such payments become due, and shall keep the Premises free and clear from
<br />all liens and encumbrances for such materials, services, and labor.
<br />63 Insurance. Lessee shall, at all times while conducting Mining
<br />Operations, comply fully with the applicable worker's compensation laws and purchase
<br />standard form insurance policies for (i) comprehensive public liability and property
<br />damage with combined limits of 51,000,000 Dollars for bodily injury and property
<br />• damage, (ii) automobile insurance with combined limits of 51,000,000 Dollars, and (iii)
<br />umbrella coverage with combined limits of $5,000,000 Dollars.
<br />6.4 Indemnification. Lessee agrees to protect, indemnify and hold
<br />harmless Lessor from liens, damages, losses, expenses, demands and causes of action
<br />claimed by or arising in favor of any person, firm, or corporation, including without
<br />limitation, Lessee, its officers, directors, agents, employees and its contractors or sub-
<br />contractors or of their officers, agents, or employees on account of personal injuries,
<br />death claims, or damages to property of any persons arising from, growing out of or
<br />incident to the operations conducted on the Premises and /or the Unitized Premises by
<br />Lessee or its contractors or subcontractors, or to the entrance of Lessee or its officers,
<br />directors, agents, or employees on the Premises. Lessee, at its own expense, shall defend
<br />any suit or action brought against Lessor based on any such alleged injury, death, or
<br />damage, and shall pay all damages, costs and expenses, including attorneys fees in
<br />connection therewith or in any matter resulting therefrom. Tne indemnification herein
<br />contained shall survive any surrender, termination, or expiration of this Lease and, unless
<br />expressly provided to the contrary, shall be conclusively deemed not to have merged into
<br />any other document hereafter executed pursuant to the provisions of this Lease.
<br />65 Release of Premises. Lessee shall execute a release af.eop.rMiw
<br />of the Premises at such time as it has completed Mining Operations and reclamationoi
<br />4WOM 4. Such a release shall
<br />terminate Lessee's obligations under this Lease as of. -�—
<br />the time the release is recorded except for those obligations accrued as of the date of
<br />the release, including, but not limited to, any and all responsibilities provided for in
<br />Article V, and such other obligations as would survive the termination of this Lease.
<br />Roads and other means of conveyance which have been constructed across the released
<br />lands may be used for the duration of the Lease as to the remainder of the Premises
<br />and the Unitized Premises.
