A-6k <br />ENECA <br />Property, LLC Seneca Property, LLC <br />Landowner Date <br />Mailing Address <br />City, State Postal Code <br />Re: Permanent Retention and Maintenance of Ponds and Drainage Features <br />Dear Landowner: <br />In conjunction with their mining and related operations, Seneca Property, LLC (SP) constructed, operated, <br />and has inspected and maintained Pond(s) and the related drainage structures. Recognizing the <br />value of the existing water storage and distribution systems, SP has applied for and obtained the necessary <br />approvals from the Colorado Division of Reclamation, Mining, and Safety (CDRMS), to retain Pond(s) <br />_ and the related drainage structures as a permanent impoundment(s) to support the approved <br />postmining land use(s). <br />SP will continue to inspect and maintain the referenced pond(s) and associated drainage structures until <br />such time as full bond release for the associated mine disturbance areas is obtained (currently anticipated <br />in approximately . At that time ownership and responsibility for ongoing inspection and <br />maintenance of the pond(s) and related drainage structures will transfer to you as the landowner. <br />As the landowner, and as indicated by my signature below, I agree to inspect and maintain the referenced <br />pond(s) and associated drainage structures so long as they are being used to support the postmining land <br />use(s). The pond(s) and related structures will be inspected at least once a year, and maintenance and <br />repair activities will be performed as needed to assure the integrity and continued effective functioning of <br />the pond(s) and associated structures. <br />If, as the landowner, I determine that the pond(s) no longer serves a beneficial purpose, I reserve the right <br />to breach any embankment structure to allow unimpeded flow through the pond(s), and to remove any <br />associated structures.
