The division <br />finds that the monitoring frequency of Gob Piles Two and Three cannot be reduced. Rule <br />4.10.2(2)(a) states that, "Inspections shall occur at least quarterly..." The rule allows the <br />Division to require a more frequent monitoring frequency of coal mine waste banks, but no less <br />than quarterly. The Division would consider a reduced frequency after the Gob Piles have been <br />graded and covered in accordance with Rule 4.06.4, and revegetated.
