In TR -75, Mr. Moore, Mr. Staats and Mr. Goforth submitted letters requesting that the NE Haul Road and <br />the footprints of the former topsoil piles F and G remain as permanent features on their respective <br />properties. Their letters can be found in permit Section 2.05.4(2)(e) Attachment 2.05.4(2)(e)-12. The road <br />was reduced in width, excess road material was removed and topsoil was replaced and seeded. The <br />footprints of the topsoil stockpiles were ripped and seeded. The seed mix used was determined by the <br />post -mining land use of the surrounding area. <br />Mr. Guire requested that the portion of the NE Haul Road that crosses his property be reclaimed rather <br />than be left as a permanent feature. For this portion of the road, all the road material was removed, topsoil <br />replaced and the area seeded with an irrigated pasture seed mix. Culverts 110 and 111 were removed and <br />the drainages were re-contoured to blend in with the surrounding landscape. <br />A utility road was constructed in 2009 as a maintenance access for the CCC Ditch Company Box 1 <br />(headgate). The road is located on the eastern side of the Van Kirkwood and Richards properties. The <br />road is a single lane dirt road with a small paved section at the north end used for a vehicle turnaround. <br />Mr. Van Kirkwood and Mr. Richards have submitted letters requesting this section of road to remain. The <br />letters were incorporated into the permit in MR -103 (approved November 23, 2016) and can be found in <br />permit Section 2.05.3(3) Attachment 2.05.3(3)-17. <br />The portion of the BB Road Detour on the Richards property was reclaimed in 2009. The asphalt was <br />removed and the land was contoured to blend in with the surrounding landscape. At the location of the <br />former pond 14 area, where the road turns to the west immediately south of Tuttle Draw, a small depression <br />was restored to match the pre -mining landscape. On the western side of the reclaimed road area, four rock <br />terraces are in place where the road made sharp turn on a steep hillside. The terraces were constructed to <br />assist with slope stability and minimize erosion. All areas on the Richards property were seeded with the <br />Dryland Pasture Seed Mix #8 in 2009. <br />The portion of the BB Road Detour on the Benson East property was left in place at the request of the <br />landowner, Mr. Carl Benson. The request was made in a letter dated October 14, 2003 which is found in <br />Attachment 2.05.3(3)-8 of the permit. Culverts C-119 through C-124 are associated with this section of <br />road and were also left in place. WFC has been maintaining these culverts. <br />V. Summary and Conclusions <br />Based upon a review of the mine permit, the applicant's bond release application, and site inspections, the <br />Division finds that Western Fuels -Colorado, LLC has completed backfilling, grading and drainage <br />reestablishment for the disturbances that are the subject of SL -18 in accordance with their approved <br />reclamation plans. <br />VI.
