SL -12 requested Phase H bond release for 26.8 acres and Phase III bond release for 149.9 acres. The <br />application was withdrawn on June 13, 2012. <br />SL -13 approved Phase I bond release on 100.16 acres and Phase II and III on 7.22 acres. The application <br />was approved on November 4, 2013. <br />SL -14 requested Phase II bond release for 26.8 acres and Phase III bond release on 216.7 acres. The <br />application was withdrawn on July 25, 2013. <br />SL -15 requested Phase II bond release for 77.4 acres. The application was submitted on July 23, 2015 <br />and was deemed complete on August 12, 2015. An inspection was conducted with the landowners on <br />August 18, 2015. The application is currently under review. <br />SL -16 requested Phase I bond release for 107.8 acres west of the 2700 Road. The bond release was <br />approved on February 16, 2016. <br />SL -17 requested Phase I, II and III bond release on 9.4 acres Montrose County Road 50' Street and BB <br />Road west of the 2700 Road. The bond release was approved on March 1, 2016. <br />SL -18 was received by the Division on January 26, 2016. The application was deemed complete on March <br />25, 2016, after the Division received proof of publication of the applicant's public notice. WFC published <br />notice of the bond release application in San Miguel Basin Forum once weekly for four consecutive weeks, <br />beginning February 18, 2016. WFC also notified land owners within and adjacent to the mine permit area <br />and other interested parties of the application for bond release, as required by Rule 3.03.2(1). <br />The Division scheduled and conducted a bond release inspection on April 12, 2016 at 10 am. The site <br />inspection was conducted in accordance with Rule 3.03.2(2). In attendance for the inspection were <br />landowners Rose Anne Guire, Jim Guire, Michael Moore, Melvin Staats, Lester Goforth and Bud Benson. <br />These landowners own portions of the 23.5 acres that are the subject of SL -18. Landowner Dirk Richards, <br />who also owns a portion of the 23.5 acres, was notified of the inspection but was unable to attend. Mike <br />Morgan, representing Slash M, an entity that owns land within the permit area but does not own a portion <br />of the 23.5 acres, also attended the inspection. Frank Ferris (WFC), Tony Tennyson (Tri-State), Trevor <br />Ragsdale (WFC) and Tom Fry (WFC) attended the inspection. OSMRE was also invited, but was not <br />able to attend. With the exception of Mike Morgan, all parties were notified of the inspection by phone <br />call and certified mail. <br />Comments were received from Ms. JoEllen Turner in a fax dated April 16, 2016. Ms. Turner is not an <br />owner of land subject to SL -18; however, Ms. Turner resides near the mine. Ms. Turner's comments <br />were largely centered on the theme that `haul roads should not have a ten year bond period in a farming <br />community.' The Division replied to Ms. Turner's comments in a May 5, 2016 letter. Although the <br />Division did not agree with Ms. Turner's interpretation of the Rules regarding the ten-year liability <br />period as it applies to reclaimed haul roads, the Division did recognize the challenges to land <br />management and agricultural productivity that could occur when farmland is Phase III -released in <br />discontinuous blocks over various years.
