Page 4 of 6 <br /> January 6, 2017 <br /> The remaining 53.145 acre-feet of required replacement water wilt be provided through <br /> operation of the augmentation plan decreed in case no. 13CW3060. <br /> CONDITIONS OF APPROVAL <br /> This SWSP is hereby approved pursuant to Section 37-90-137(11), C.R.S., subject to the following <br /> conditions: <br /> 1. This SWSP shall be valid for the period of June 1, 2016 through March 31, 2017, unless <br /> otherwise revoked, modified, or superseded by decree. Should an additional SWSP be <br /> requested, such renewal request must be submitted to this office with the statutory fee <br /> of $257 per gravel pit at least 45 days prior to the expiration date of this plan. Once <br /> reclamation is complete and the release has been obtained from DBMS, the applicant <br /> must submit the SWSP renewal pursuant to C.R.S. 37-90-308(4) and an augmentation <br /> plan application filed in Division 2 Water Court. <br /> 2. Well permit no. 52184-F has been obtained for the exposed pond surface area of the <br /> North Gateway Park Ponds in accordance with 937-90-137(2) and (11), C.R.S. <br /> 3. Each pond must be equipped with a staff gage surveyed property, related to the stage- <br /> area-capacity table for the pond in order to account for refill volume in compliance with <br /> the Division Engineer's Functional Standards for Reservoir Stage/Area/Capacity Data . <br /> 4. No more than 32.87 acres (25.87 acres of post-1981 exposure) may be exposed at the <br /> North Gateway Park Ponds during this plan year without first obtaining a new SWSP. <br /> Documentation of pond size may be required by the Division Engineer in the form of <br /> an aerial photo evaluation or survey by a Professional Land Surveyor during the plan <br /> year or in years covered by subsequent renewals of this plan. <br /> 5. Approval of this SWSP is for the purposes stated herein. Any additional uses for which <br /> the water may be used will require that a new SWSP be obtained. <br /> 6. The Applicant shall provide daily accounting (including, but not limited to diversions, <br /> depletions, replacement sources, and river calls) on a monthly basis. The accounting <br /> must be emailed to the Water Commissioners (Rebecca.Nichots@state.co.us and <br /> Lonnie.Spady@state.co.us) and to the Division Engineer (email to <br /> Augmention.Coordinator@state.co.us), within 30 days of the end of the month for which <br /> the accounting applies. Accounting and reporting procedures are subject to approval and <br /> modification by the Division Engineer. Accounting forms need to identify the WDID <br /> number for each well operating under this SWSP. NOTE: Monthly accounting, even during <br /> the winter non-irrigation season, is required. <br /> 7. The name, address, and phone number of the contact person who will be responsible for <br /> the operation and accounting of this SWSP must be provided with the accounting forms to <br /> the Division Engineer and Water Commissioner. <br /> 8. Credits to be used for depletions at pit sites below the point of credit must be made <br /> available by daily coordination with the Division Engineer's Office to affect delivery past <br /> any intervening ditches or through reservoirs to the point of depletion. Credits not <br /> delivered in the above manner shall not be counted against downstream depletions. <br /> 9. Conveyance loss for delivery of augmentation water to the Arkansas River is subject to <br /> assessment and modification as determined by the Division Engineer. <br />
