The required $257 fee for the renewal of this SWSP has been submitted <br /> (receipt no. 3674793). The previous SWSP was approved pursuant to Section 37-90-137(11), <br /> C.R.S., with an expiration date of May 31, 2016. The Lamar East Gravel Pit was previously <br /> renamed as the Lamar North Gateway Park Pond Nos. 1, 2 and 3 ("North Gateway Park Ponds" or <br /> "Ponds"), and will be referred to as such with the renewal of this SWSP. <br /> On December 18, 2013 Lamar made application for approval of a plan for augmentation and <br /> appropriative right of exchange concerning the North Gateway Park Ponds in Division 2 Water <br /> Court case no. 13CW3060. According to the May 25, 2016 SWSP request, Lamar is proposing to <br /> utilize water provided by Colorado Parks and Wildlife ("CPW") by agreement dated March 29, <br /> 2016. Said water will be from the CPW water portfolio available from the Water Management <br /> Agreement between CPW and the Lower Arkansas Water Management Association ("LAWMA") <br /> and is not listed as a source of replacement water in the plan for augmentation and <br /> appropriative right of exchange decreed in Division 2 Water Court case no. 13CW3060; therefore, <br /> this SWSP request has been evaluated and approved pursuant to Section 37-90-137(11), C.R.S. <br /> The Applicant has requested an approval period from November 1, 2015 through May 31, 2017 <br /> for this SWSP due to the increase in exposed ground water area during the 2015-2016 SWSP <br /> period. For this office to amend an existing SWSP, a new application must be submitted at or <br /> before the time the change is required.
