This document presents the proposed decision of the Colorado Division of Reclamation, Mining and <br />Safety (the Division) for the SL -01 Phase UII/III Bond Release/Termination of Jurisdiction (TOJ) for <br />the Ohio Creek Mine No. 2 permit revocation/bond forfeiture site. The Division file number for the <br />site is C-1980-002. The permittee of the site at the time of permit revocation and bond forfeiture in <br />1996 was Mr. Robert Weaver. The permit area covered 88.5 acres. Under consideration for TOJ <br />are surface disturbances totaling 3.22 acres, areas overlying previously -proposed underground <br />workings and actual underground workings, and the 88.5 -acre permit area. Ownership of the surface <br />within the permit area is private. The coal that was mined was leased by the US Bureau of Land <br />Management (BLM Lease No. CO -069942). This TOJ process (SL -01) was initiated by the Division <br />following reclamation of the site, expiration of the Division ten-year reclamation liability period, and <br />completion of vegetation sampling at the site in 2015 and 2016. <br />Though this site is presently a permit revocation/bond forfeiture site, the Division nevertheless <br />followed the requirements for review, public notice and public participation for a bond <br />release application for a permitted site in accordance with Rule 3.03 of the Regulations of the <br />Colorado Mined Land Reclamation Board for Coal Mining (the Rules).
