BACKGROUND and HISTORY of the OHIO CREEK MINE NO. 2 <br />The Ohio Creek Mine No. 2 was opened in 1943 and operated until its first closure in 1964. <br />Henry Weaver re -opened the mine in July of 1968 and operated it through October of 1968. <br />At that time, Macar Mining Corporation sub -leased the mine and operated it until July 1981, <br />when it terminated its sub -lease. Henry and Opal Weaver at that time took over the mine's <br />operations. While active, the mine produced approximately 7,000 to 10,000 tons of coal <br />per year from Federal Coal Lease No. CO -069942. The mine was closed in 1992 due to <br />poor roof conditions that made mining unprofitable and unsafe. <br />The federal Surface Mining Control and Reclamation Act (SMRCA) was passed on August 3, <br />1977, creating the US Office of Surface Mining, Reclamation and Enforcement (OSM). This <br />federal law allowed states with active coal mines to establish state -administered coal mining <br />regulatory programs, overseen by OSM, in lieu of OSM being the regulatory authority. The <br />State of Colorado applied to OSM to establish the Colorado coal regulatory program.
