no one from the public and no landowners' representative attended the final inspection. <br />The Division (DRMS) received no comments from the landowners. <br />VII. PROPOSED DECISION <br />Based on the observations above, the Division proposes to approve SL -01 and terminate its <br />jurisdiction over the Ohio Creek Mine No. 2. This proposed decision will release Robert Weaver and <br />the Division from liability for all reclamation work at the site. This release and termination of <br />jurisdiction apply to the entire permit area. <br />The original performance bond for the Ohio Creek Mine No. 2 at the time of bond forfeiture was <br />$36,000. The Division currently holds unused forfeited bond monies in the amount of $11,227. <br />Based on the observations above, the Division proposes to return this $11,227 to the Bank of the <br />West in Gunnison, Colorado. The Division finds that all surface coal mining reclamation <br />operations have been completed in accordance with the approved reclamation plan and meet all <br />requirements of the Rules and the Act, to the extent possible considering the revoked nature of <br />the permit. The site has successfully achieved the post -mining land uses of rangeland and <br />wildlife habitat. <br />Any person with a valid legal interest which might be adversely affected by this proposed <br />decision may request a formal public hearing before the Colorado Mined Land Reclamation <br />Board in accordance with Section 3.03.2(6). Public notice of this proposed decision will be <br />published in the Gunnison County Times once a week for two weeks as soon as possible. <br />Requests for public hearing must be submitted to the Division in writing within thirty days of <br />the first publication in the Gunnison County Times.
