Mine No. 2 (Permit No. C-1980-002) <br />Bond Release Application No. 1 (SL -1) <br />Dear Gunnison County Commissioners: <br />This letter, as required by Rule 3.03.2(5)(a) of the Rules and Regulations of the Colorado Mined <br />Land Reclamation Board for Coal Mining, is to inform you that the Division of Reclamation, <br />Mining and Safety has issued a proposed decision to approve Bond Release Application No. 1 <br />for the O.C. Mine No. 2. This decision will be published in the The Gunnison County Times as <br />soon as possible. Publication of the notice initiates a thirty (30) day public comment period. If, <br />within thirty days, there are no requests for an adjudicatory hearing, the decision will become <br />final. <br />This decision constitutes a full release of reclamation liability for the O.C. Mine No. 2. Pursuant <br />to Rule 3.03.3(1), the Division is proposing to terminate its jurisdiction over this entire coal <br />mining operation. <br />As an interested party, you have the right to an adjudicatory hearing as outlined under Rule <br />3.03.2(6) of the Rules and Regulations. The request for an adjudicatory hearing must be written <br />and state with specificity the reasons why the hearing is requested. The request must be received <br />within thirty days of the first publication of the proposed decision in the The Gunnison County <br />Times. <br />Copies of the proposed decision and findings are available for review at the Gunnison County <br />Clerk and Recorders Office, 221 N. Wisconsin St., Gunnison Colorado 81230; the Division <br />office 1313 Sherman Street, Room 215, Denver, Colorado 80203, and on the Division's website <br />at httn•//mining state co us/Rcaorts/MininaData/Paces/ImaacdDocumentData.as12x.
