Seneca II West, C1982-057, RN6, PAR
S1Page
11. The Division has updated the reclamation cost estimate associated with the Seneca
H 1J'est permit. The updated reclamation cost liability for the Seneca H TVest Mine
is ,4,046, 578.00. The previously approved reclamation liability with the approval
of SLS rias $4, 929, 064.00. The di fference of these values are attributed to
reduction in diaration of some of the tasks, for example site maintenance, .sediment
pond cleaning -based on data submitted bl, Seneca Property, LLC, and correction
of unit costs. Seneca Property, LLC is currently approved.for a self -bond in the
amount of 55,818,456.00. A copy of the estimate is attached.
SP replaced the self -bond with a corporate surety in the amount of $5,818,456.00
on April 1, 2016. On September 19, 2016, SP requested a bond reduction based
upon the RN6 reclamation cost estimate conducted by the Division. The Division
responded SP may request a bond reduction as a TR after the approval of RN6.
Based upon information told to the Division inspector during the fall of 2016, a new
landowner has purchased property formerly owned by the John Ricks Family Trust. As a
result of this information the Division has this additional adequacy concern:
12. Please update the surface ownership map, Exhibit 3-1, Tab 3, land owner
information, and right of entry agreement with the name and address of the new
landowners on the property formerly owned by the John Ricks Family Trust.
In accordance with SP's request, the proposed decision date has been extended until
January 20, 2017. This should allow time for SP to respond to the remaining adequacy
concerns, items 10, and 12.
Sincerely,
(r --
Janet H.
