Jointly Administered Related to Docket No: 1478 SECOND ORDER (I) AUTHORIZING THE DEBTORS TO (A) ASSUME CERTAIN UNEXPIRED LEASES OF NONRESIDENTIAL REAL PROPERTY AND (B) REJECT CERTAIN UNEXPIRED LEASES OF NONRESIDENTIAL REAL PROPERTY AND (II) GRANTING RELATED RELIEF This matter coming before the Court on the Fifth Omnibus Motion of the Debtors for an Order (1) Authorizing Them to (A) Assume Certain Unexpired Leases of Nonresidential Real Property and (B) Reject Certain Unexpired Leases of Nonresidential Real Property and (II) Granting Related Relief (the "Motion"),' filed by the above -captioned debtors and debtors in possession (collectively, the "Debtors"); the Court having previously granted the Motion in part and adjourned the Motion in part [Docket No. 1639]; the Court having reviewed the Motion and having considered the statements of counsel with respect to the Motion at a hearing before the Court (the "Hearing"); the Court having found that (a) the Court has jurisdiction over this matter pursuant to 28 U.S.C. §§ 157 and 1334 and Rule 81-9.01(B)(1) of the Local Rules of the United States District Court for the Eastern District of Missouri, (b) this is a core proceeding pursuant to 28 U.S.C. $ 157(b), (c) notice of the Motion and the Hearing was sufficient under the circumstances, (d) service of the Assumption Notices and Rejection Notices provided the counterparties to the Leases with adequate notice of the potential assumption or rejection of each Capitalized terms used but not otherwise defined herein shall have the meanings given to them in the Motion.
