<br />11 <br />Land Reclamation Board at an anticipated hearing. <br /> RESPONSE: Newmont has held two formal meetings with Mr. DuBois regarding the <br />City of Cripple Creek’s Amendment 11 comments. Lisa Becker, External Relations <br />Manager, and Jack Henris, General Manager, met with Mr. Dubois on August 4th, <br />and again with Mr. Dubois, along with Deb Downs and Mayor Buck Hakes from the <br />City of Victor, on September 13th to discuss the comments. Additionally, Amendment <br />11 information has been provided to both the City of Cripple Creek and the City of <br />Victor during quarterly community leader breakfasts and public community open <br />houses. Lastly, informal discussions were held with Mr. DuBois on other occasions <br />including an informal meeting on September 27th, whereby Mr. DuBois requested a <br />written response to each of the City’s comments. A response letter and updated map <br />were completed and emailed (per the City’s request) on September 30, 2016. <br />Newmont has responded to every point raised by the City in its comment letter dated <br />March 29, 2016. In addition, Newmont provided the City a map that included all of <br />the boundaries mentioned in its letter to aid in review. <br />Responses to the specific points raised in the Division’s comment are provided below. <br />1) Location of Proposed Haul Road. Please see response to Comment 6 above. <br />2) A drawing with all of the boundaries identified by the City in its March 29, 2016 <br />letter, including the city limits of Cripple Creek, was provided to the City on <br />September 30, 2016. A detail of the Poverty Gulch area showing the proposed A-11 <br />affected lands boundary, the Historic Recreation Area Boundary and the city limits <br />of Cripple Creek also was provided in an email to the Division and Teller County on <br />November 8, 2016. Note, the proposed Amendment 11 affected lands boundary lies <br />entirely outside the city limits of Cripple Creek. Newmont has included the city limits <br />on revised Drawing C-3 (see Attachment 1) and will be happy to include on future <br />drawing revisions, if needed to aid in the Division’s review. <br />3) Item 8 – Newmont has removed the proposed water line on Drawing C-3 as shown <br />in Attachment 1. Newmont is currently evaluating where it will source water for the <br />Chicago Tunnel operations and will not tap into the City water system without <br />consulting with the City and obtaining the proper permits. <br />4) Item 9b. Public Roads. Primary access to the Chicago Tunnel area will be by way <br />of the Iron Clad Security mine access through the mine property. <br />5) Item 9i. – Water encountered in the Chicago Tunnel will be captured and re-used <br />during drilling operations. It is anticipated that we will need to bring water into the <br />Chicago Tunnel to support operations and there will be zero discharge from the <br />underground activities. Regardless, water encountered in the Chicago Tunnel will <br />be managed in accordance with regulatory requirements and if treatment or a <br />discharge permit is necessary, Newmont will apply for the appropriate CDPS permit.
