AM-06 Stipulations <br /> V. Climax will provide a calculation of the tributary area to the East <br /> Interceptor Ditch prior to alteration of the East Interceptor Ditch, and will provide an <br /> estimate of the modified East Interceptor drainage area. <br /> (b) Robinson Lake operations: <br /> i. An Operating Plan, to be included in the EPP, will be established <br /> for Robinson Lake Reservoir to prevent overflow through the spillway under the <br /> conditions described in subsection (ii)below. <br /> ii. The EPP will include discussion of flood storage in Robinson <br /> Lake. At a minimum, the Operating Plan will require Climax to maintain available <br /> storage capacity for the state-approved Site-Specific PMP event plus seepage water from <br /> the 1 Dam, 4 Dam, and Robinson Dam seepage collection systems. Additional storage <br /> capacity for the 100-year snowmelt will be required during the times of the year when <br /> snowmelt is occurring. The assumptions on which the operating criteria will be based <br /> should include operating parameters that would accommodate a failure of Chalk <br /> Mountain Interceptor during a PMP, and the assumption that Chalk Mountain Reservoir <br /> will spill into Robinson Lake. Flood routing analysis for Robinson Lake will be <br /> incorporated into site-wide modeling for all Climax facilities. If Climax intends to rely on <br /> removal of water by pumping from Robinson Lake via the barge system or other system, <br /> this removal will be modeled in conjunction with other flood modeling(as an inflow to <br /> the Tenmile Creek basin) to ensure that these facilities in the Tenmile Creek Basin will <br /> have adequate storage and/or discharge capacity to handle the added flow. <br /> iii. The Robinson Lake Operating Plan will include procedures that <br /> will prevent Robinson Lake from being used for flood storage from Tenmile TSF or <br /> Robinson TSF when doing so would result in water levels in the lake that exceed the <br /> operational thresholds required for storage of water from the Eagle River Basin plus <br /> additional seepage flows identified in the operational rules. Climax's currently-approved <br /> CDPS permit acknowledges the possibility of bypass and upset events through the outfall <br /> on Tenmile Creek. Flood flows would not be routed to Robinson Lake from the Tenmile <br /> Creek basin during such events when doing so would be contrary to the Robinson Lake <br /> Operating Plan. <br /> iv. An annual report will be prepared that documents the flood storage <br /> and release status for the year. Climax will provide a copy of this report to Eagle Park <br /> Reservoir Company and the Clinton Ditch&Reservoir Company concurrently with its <br /> provision to the Division. <br /> (c) Eagle Park Reservoir: <br /> i. The Revised EPP, and the SPCC and MCP documents for the Site, <br /> will remove all references to the use of,or reliance on, Eagle Park Reservoir as a <br /> containment or environmental protection facility. <br /> ii. Updates and future revisions to the EPP shall not include reference <br /> to any MCP or SPCC that provides for the use of Eagle Park Reservoir as a containment <br /> facility. <br /> 3 <br /> Exhibit A i <br /> AM-06 Settlement Agreement <br />
