PERMIT #: M-2016-076 <br />INSPECTOR'S INITIALS. ECS <br />INSPECTION DATE: December 14, 2016 <br />OBSERVATIONS <br />This was a pre-operation inspection conducted by Eric Scott for the Division of Reclamation Mining and Safety <br />(DRMS). DRMS met with permittee representative Mark Johnson and his consultant Andy Rodriguez at the <br />site entrance at approximately 9:30. The site is accessed from the west side of Weld County Road 25 <br />approximately 1.6 miles north of the intersection of WCR 25 and Highway 18. The majority of the proposed <br />permit area is currently agricultural land, however, the following issues were noted during this inspection and <br />will need to be resolved prior to the approval date of the permit. <br />1) Permit Boundary markers were not present. Several modifications from the permit boundary shown <br />on the application maps were discussed during the inspection including removing WCR 25 from the <br />permit area, and shifting of the northern permit boundary to accommodate Ft. Lupton for annexation <br />purposes. The permit boundary will need to be finalized, properly surveyed and marked in the field, <br />and all submitted maps will need to be updated appropriately. This issue will need to be resolved and <br />DRMS contacted to schedule a follow-up inspection prior to the decision date. All utility easements <br />and setbacks should also be clearly marked prior to mining activity in the area. <br />2) Structures were observed on-site, or within 200 feet of the permit boundary that are not shown on the <br />pre -mining conditions map submitted with the application. All structures and supporting utilities <br />currently present within the permit boundary, and within 200' of the permit, must be shown on the <br />existing conditions/pre-mining maps submitted to DRMS with the application. These structures will <br />also need to be included in Exhibit S of the application. <br />3) Temporary housing, vehicles/trailers, miscellaneous refuse and non -mining related activity present <br />within the permit boundary. These structures and items should be removed from the area to be <br />permitted prior to the permit decision date, or addressed in the application as appropriate. <br />DRMS also delivered a copy of a letter of objection to the permit application received by the Division during <br />the public comment period. This application is now be subject to the approval process for a 112c application <br />with objections unless the objection is withdrawn. Permit approval cannot be issued at the DRMS staff level <br />and will require a hearing by the Mined Land Reclamation board.
