It is proposed to be used as a natural gas <br /> facility in the future. <br /> Cell B is a mitigated wetland area. Cell E is currently a ground water pond. The pond is proposed to be <br /> backfilled for a future parking lot and storage areas, with a small pond remaining at the east end of Cell E to <br /> maintain an overflow and outlet structure. The Board of County Commissioners of Weld County filed an <br /> Application for Storage Rights and Plan for Augmentation in Division 1 Water Court under case no. 2012CW304. <br /> The Application for Plan for Augmentation was bifurcated on May 6, 2015 into case no. 2012CW304-B, and a <br /> decree was entered in case no. 2012CW304-B on February 1, 2016. The augmentation plan replaces <br /> evaporative depletions from a surface area of 6.6 acres in Cell 1, with an additional 2.3 acres found to be pre- <br /> 81 and not requiring replacement. Cell 1 includes the land areas designated as Cell B and Celt E. The total <br /> surface area of Cell 1 is limited to no more than 8.9 acres. <br /> Cell D will not be reclaimed or reseeded. It is proposed to be used for future storage and stockpiling of <br /> construction materials. <br /> This office has no objection to the subject requests for partial acreage release so long as Weld County operates <br /> according to the terms and conditions of its decreed plan for augmentation, including that the total surface area <br /> of ground water exposed in Cells B and E does not exceed 8.9 acres (including 2.3 pre-81 acres).
