On May 23,2016,Operator admitted the violation and agreed{to the <br /> Division's recommendations to the Board. <br /> 7. At its June 22,2016 meeting,the Board approved the consent agreement <br /> between the Division and the Operator. By written order effective July 6,2016 ("July 2016 <br /> Order"),the Board ordered the Operator to,within ninety days,submit a complete permit <br /> amendment application to increase the size of the 112c reclamation permit to include,at a <br /> minimum the affected lands out5ide the approved permit boundary. The permit <br /> amendment application was due by October 4, 2016. <br /> 8. On October 31,2016,the Operator submitted.a written request for a 1210-day <br /> extension of time to comply with the corrective action ordered in the July 2016 Order. <br /> 9. The Division does not oppose the Operator's request for an extension of time. <br /> CONCLUSIONS OF LAW <br /> 10: The Board has jurisdiction over this matter pursuant to the:Ealoradoa Land <br /> Reclamation Act for the Extraction of Construction Materials ("Act"),Article 32.5 of Title <br /> 34, C.R.S. <br /> ORDER <br /> Based on the foregoing findings of fact and conclusions of law,the"Boardbereby grants <br /> the Operator's request for an extension of time.
