5. On October 16,2013,the Division received a letter from the Operator stating <br /> that it could not post the additional financial warranty. <br /> 6. On December 13, 2013,the Division mailed a Notice of Possible Violation <br /> Letter to the Operator for failure to post the additional financial warranty within sixty days. <br /> 7. On January 9,2014,the Division withdrew the September 19, 2013 financial <br /> warranty increase to allow the Operator additional time to remove refuse from the site. <br /> 8. On March 8,2016,the site's first five-year term of temporary cessation <br /> expired. The Operator has not applied for an additional term of temporary cessation. The <br /> site is considered active. <br /> 9. On May 27,2016,the.Division conducted a monitoring inspection of the site. <br /> The Operator did not attend the inspection. <br /> 10. During the May 27, 2016 inspection,the Division found that both the mine and <br /> mill sites contained refuse,scrap metal,and mining equipment in various states of disrepair. <br /> At the mill site,the Division observed that the doors to the north site of the mill building <br /> were unlocked and accessible to the public. The Division also observed several holes in the <br /> roof of the mill building,that the roof of the mill building is sagging,and the presence of <br /> graffiti on the walls of an office on the second floor. The Division observed numerous <br /> unlabeled containers of various reagents: three twenty-gallon containers of sodium <br /> hydroxides solution;one fifty-five-gallon drum of caustic soda;and two fifty-five-gallon <br /> drums containing unidentified substances. The Division also observed a storage area <br /> containing fifteen fifty-five-gallon drums of unlabeled chemicals and reagents. The storage <br /> area was found behind an unlocked door that is accessible to the public. <br /> 11. In its May 27,2016 inspection report,the Division noted that the permit for <br /> the site states that the ore body at the site contains pyrite,a sulfide mineral that generates <br /> acid when it is subject to oxidation. The Division found that the Golden Gilpin Mill site <br /> contained tailings which generate acid drainage. The Division noted in the inspection report <br /> that the site may qualify as a Designated Mining Operation. <br /> 12. Ou Jidy 6,2016,the Divis.jo&mailed the Operator a Notice of Financial <br /> Warranty Increase letter,together with a detailed cost summary. The Notice of Financial <br /> Warranty Increase letter stated that the financial warranty was increased from$5,000 to <br /> $149,721. <br /> 13. On September 5, 2016,the increased financial warranty was due from the <br /> Operator. The Division did not receive the increased.financial warranty by that date or at any <br /> time since. <br /> 14. On October 17, 2016,the Division mailed a Notice of Possible Violation Letter <br /> to the Operator for failure to post the additional financial warranty within sixty days. <br /> Central City Consolidated Mining <br /> M-1990-041 <br /> MV-2016-056 2 <br />
