governing injury to existing water rights;
o Compliance with applicable federal and Colorado water quality laws
and regulations...;
o Compliance with applicable federal and Colorado dredge and fill
requirements; and
o Removing temporary or large siltation structures from drainage ways
after disturbance areas are revegetated and stabilized, ifrequired by the
Reclamation Plan.
Newmont maintains substitute water supply plans and water purchase
agreements to comply with water rights issues. In addition, Newmont maintains
active CDPS permits at three locations as well as a general stormwater permit
for the site. The activities associated with Amendment 11 do not involve dredge
and fill permits and therefor this section does not apply, however, past
amendments have included correspondence with the US Army Corps of
Engineers to permit dredge and fill activities. Lastly, Newmont intends to
follow the Reclamation Permit for removing EMPs and sedimentation ponds
once they are no longer required to control surface runoff from disturbed
areas, thereby satisfying the requirements of subsection (d) to this Rule.
Page 8 of 8
