PERMIT#:M-2000-082 <br /> INSPECTOR'S INITIALS: ECS <br /> INSPECTION DATE: December 6,2016 <br /> OBSERVATIONS <br /> This inspection was conducted by Eric Scott and Peter Hays of DRMS as a result of a citizen complaint received <br /> by DRMS on December 1, 2016. The complaint letter received from the owner of 417 E 8th Street, Greeley CO <br /> alleges that the mining activity taking place at the adjacent sites, M2000-082 to the South of his property and <br /> the subject of this inspection, and M1985-112 to the North of his property have impacted the property's <br /> historic well. This well is now unable to provide sufficient water to satisfy the requirements of the residence <br /> at that location. This issue was previously reported to DRMS on March 7, 2016 and was thought to have been <br /> resolved. Please refer to the inspection report dated March 11, 2016 for additional background information <br /> regarding this complaint. <br /> During the inspection, DRMS met with property owner Jack Tyrrell. Mr. Tyrrell allowed DRMS to observe the <br /> historic well (see attached photos 1-4), and related his experiences to-date. Mr. Tyrrell stated that the well <br /> had been providing sufficient water at the end of the summer, however, recently it had "gone dry again". <br /> DRMS proceeded to the E 81h Street Operation at approximately 10:20 and met with permittee Jack Miller and <br /> Jim McFarland. They stated that they had ceased dewatering in the western mined cell closest to the Tyrrell <br /> property in July of 2016, however, due to water augmentation requirements, they had been required to <br /> resume dewatering of this cell in early to mid-November. In the interval between July and November the <br /> water only rose approximately 3-4 feet in the 50 foot deep unlined cell, as can be seen from the high water <br /> line on the pit slopes (see attached photos 5-6). <br /> Part of the corrective actions required for the E 8th Street Operation as a result of the previous 2016 complaint <br /> was to repair and/or replace the on-site monitoring wells, and resume monthly groundwater level monitoring <br /> as required. These actions were completed by the Operator. The most recent set of groundwater level data <br /> collected for the site was from December 1, 2016. At that time groundwater depths in the on-site wells <br /> ranged from 28'4" on the northwest corner of the site (nearest to the Tyrrell well) to 33'10" in depth in the <br /> south-central area of the site. <br /> Because of the recurring impacts to the Tyrrell well, DRMS will require at this time that the corrective actions <br /> in the approved Groundwater Mitigation Plan be implemented immediately. The operator will be required to <br /> report to DRMS within 10 days from the date of this report how they intend to permanently replace or restore <br /> the groundwater well located on the Tyrell property. <br /> Page 2 of 4 <br />
