June, July, August, and September) the flow in the Vulcan ditch drops below 1.6 cubic <br />felt per second, the permittee must receive Division approval based on a <br />demonstration that the water is not necessary for irrigation of the AVF before using <br />the water in the mining operation. <br />The water supply for the subirrigated area near the Colorado River is, as previously <br />discussed, groundwater flow due to irrigation from the Vulcan ditch. Since CB has <br />committed to not diverting excessive water for flood irrigation, the source of water for <br />subirrigating this area will not be affected. <br />The source of water for the subirrigated area bisected by the Vulcan ditch is a small <br />ephemeral drainage. The proposed operation will not affect any of the area tributary <br />to this drainage; therefore, there should be no effect on the water supply to this <br />subirrigated area. <br />3) The valley floor exists within the affected or adjacent area. The alluvial valley floors of the <br />Colorado River and Alkali Creek are located adjacent to but not on the disturbed area. The <br />Division finds that activities proposed by the applicant will: <br />not interrupt, discontinue, or preclude farming on the alluvial valley floors that are irrigated or <br />naturally subirrigated [2.06.8(5)(a)(i) and 4.24.3(1)]. <br />not materially damage the quantity or quality of water in the surface or ground water system <br />described above [4.24.3(3) and 2.06.8(5)(a)(ii)]. <br />will comply with the requirements of the Act and the Regulations with respect to alluvial valley <br />floors [2.06.8(5)(a)(iii)]. <br />Environmental monitoring of surface water is to continue until allbonds are released in accordance with <br />Rule.4.24.4. <br />XVIII. Operations on Prime Farmland <br />The Division has made a determination that there are no prime farmlands within the proposed <br />permit area. The decision was based on evidence provided by the Soil Conservation Service <br />which appears on pages 3-171 to 3-173 in Volume I of the PAP. The Division makes no <br />approvals with regard to such operations [4.25.2(3), 4.25.4(2), and 4.25.5(2)]. <br />XIX. Mountaintop Removal <br />There is no mountaintop removal at the site. Therefore, the Division makes no approvals with <br />regard to such operations [4.26.2(2)]. <br />XX. Operations on Steep Slopes <br />There are no operations on steep slopes at the site.
