Storm Water Management Plan (SWMP), September 2012 <br />GCC Energy – King Coal & King II Mines <br />13 <br /> <br /> <br />5.2.2.1 Burden of Proof Requirements <br /> <br />The burden of proof requirements are found in Section B.6 of the General Permit. <br />The permittee has the burden of proof when requesting relief from total <br />suspended solids (TSS), total iron, and/or settleable solids limitations. Relief shall <br />be granted only when necessary and shall not be granted when the permittee <br />has control over the discharge. The permittee should endeavor to meet the <br />primary limitations whenever possible. The Division shall have final authority in <br />determining whether relief is granted. <br /> <br />a) For rainfall it is necessary to demonstrate that: <br /> <br />1) The discharge occurred within 48 hours after measurable <br />precipitation has stopped (TSS and iron) or <br /> <br />2) The discharge occurred within 48 hours after precipitation <br />greater than the 10-year, 24-hour event1 has stopped (settleable <br />solids). <br /> <br />b) For snowmelt it is necessary to demonstrate that: <br /> <br />1) The discharge occurred within 48 hours after pond inflow has <br />stopped (TSS and iron) or <br /> <br />2) The discharge occurred within 48 hours after pond inflow <br />volume greater than the 10-year, 24-hour event has stopped <br />(settleable solids). <br /> <br />As part of its determination of the adequacy of the proof, CDPHE shall evaluate <br />whether the permittee could have controlled the discharge in such a manner that <br />primary limitations could have been met. All manual dewatering of ponds that are <br />equipped with automatic dewatering systems must meet TSS, total iron, and total <br />manganese limitations. If a pond has only manual dewatering capability, relief is <br />available only to the extent required to regain necessary stability and capacity. <br />5.2.3 Routine Reporting of Data <br />The results of data gathered in accordance with this section will be reported to <br />CDPHE quarterly. Monitoring results will be summarized for each calendar <br />quarter and reported to CDPHE on an EPA Discharge Monitoring Report (DMR) <br />form, included in Appendix B. The DMR is due no later than the 28th day of the <br />month following the end of the quarter. If no discharge occurs during the <br /> <br /> <br />1 10-yr, 24-hour return frequency rainfall is 2.20 in.
