Kym Schure and Wayne Gentry and Chris Gentry,their successors and- assigns and for any person,persons or corporation to whom the rights of the Grantors or Grantees herein shall be specifically transferred,does hereby establish these restrictive and protective covenants which shall attach to and pass with the above described real property,and shall bind all persons who may at any time hereafter own or claim any right,title or interest in and to said real property whether acquired through voluntary act or by operation of law. These covenants are to run with the land and shall be binding on all parties and all persons claiming under them for a period of twenty-five years from the date these covenants are recorded,after which time the covenants shall be automatically extended for successive periods of twenty years into perpetuity. WAIVER. Failure to enforce a covenant contained herein does not constitute a waiver of enforcement of the covenants. SEVERABILITY. Invalidation of any one of these covenants by judgment or court order shall in no way effect any of the other provisions,which shall remain in full force and effect. MISCELLANEOUS.No modifications to this Agreement shall be binding unless reduced to writing and signed by all parties. Each party signs this Agreement by their freewill and without coercion. It is agreed and understood that the berm described in the Stipulated Judgment of Logan County District Court Case No.98 CV 59 shall be regarded by all present and future parties as in effect,including all of the described specifications and stipulations regardless of the actual logistical location of the berm.That the eastern property line fence shall be erected in such a way that the eastern property line fence of the described parcel follows the western perimeter base contour of the berm between the northern most point of the berm extended to the southern most point of the berm.
