The current request is submitted pursuant to§ 37-92-308(4), C.R.S., referencing <br /> the plan for augmentation applied for in Consolidated Case Nos, 02CW122 and 10CW31. <br /> Notice was provided to the objectors in both cases on September 16, 2015. Timely comments <br /> were received from Julianne Woldridge, representing Canon Heights Irrigation& Reservoir <br /> Company and Lee Miller, representing Southeastern Colorado Water Conservancy District. The <br /> required fee of$300 has been received (receipt no. 3671582). <br /> This SWSP was originally approved on April 18, 2006, and this request seeks to extend <br /> the SWSP past five years from the original date of approval. Pursuant to§37-92-308(4)(b), <br /> C.R.S., "if an applicant requests renewal of a plan that would extend the plan past five years <br /> from the initial date of approval, the applicant shall demonstrate to the water judge in the <br /> applicable water division that the delay in obtaining a decree has been justifiable and that not <br /> being able to continue operating under a substitute water supply plan until a decree is entered <br /> will cause undue hardship to the applicant."The Applicant filed a motion with the court for <br /> findings as required under§37-92-308(4)(b), C.R.S. According to the Order approved <br /> September 15, 2015, the court granted the motion and authorized CC&V to renew its SWSP for <br /> the period November 1, 2015 through October 31, 2016. <br /> PLAN OPERATION <br /> CC&V operates a surface mining operation in the vicinity of the towns of Cripple Creek <br /> and Victor, known as the Cresson Project. The mine was originally a subsurface mine in the <br /> late 1800's, and was taken over by CC&V Mining Company in 1976.
