I. PROCEDURES AND SUMMARY OF THE BOND RELEASE PROCESS

OEI applied for complete bond release under the Colorado Surface Coal Mining and Reclamation
Act following reclamation of the Carbon Junction Mine. The mine is located in La Plata County,
in portions of Section 4, Township 34 North, Range 9 West; Section 33, Township 34 ½ North,
Range 9 West; and Section 33, Township 35 North, Range 9 West of the New Mexico Principal
Meridian, and being more particularly described as follows:

Beginning at the SE corner of said Section 33, T35N;
Thence S 89°55’10” W, a distance of 513.29 ft along the south line of said Sec 33, T35N;
Thence S 18°14’00” W a distance of 3334.13 ft to the E 1/16 corner common to said Sec 33,
