of reclamation liability granted by the Division for SL -09 will be subtracted from $97,538.03. <br />The Division proposes to release $52,216.63 in conjunction with its partial approval of Bond <br />Release Application SL -09 (Attachment 3 of this Findings Document). This proposed release <br />amount is $6,415.15 less than the amount requested by Snowcap Coal Company. The primary <br />reason for the difference is because the Division is proposing to approve a Phase II bond release, <br />but not approve a Phase III bond release, for the 1.2 acres of surface disturbance associated with <br />reclaimed Pond 11. <br />Beginning with the reduced regulatorily-required reclamation liability amount of $97,538.03, and <br />reducing that amount further by $52,216.63, the regulatorily-required reclamation liability amount <br />for the remaining disturbances at the Roadside Mme will be $45,321.40. The Division has <br />determined that the "on -the -ground" cost to complete the remaining reclamation at the Roadside <br />Mine is $44,489.49 (Attachment 4). Following the approval of Bond Release Application SL -09, <br />the Division will therefore not be establishing a new regulatorily-required reclamation liability <br />amount that would be less than the "on -the -ground" cost to complete this site's remaining <br />reclamation. Therefore, the Division will hold adequate bond monies to "assure the completion of <br />the reclamation plan if the work had to be performed by the Board, through independent <br />contractors, in the event of forfeiture", pursuant to Rule 3.02.2(1). <br />Any person with a valid legal interest which might be adversely affected by this proposed decision <br />may request a formal public hearing before the Mined Land Reclamation Board in accordance <br />with Rule 3.03.2(6). Public notice of this proposed decision will be published twice in the The <br />Daily Sentinel as soon as possible. Requests for public hearing must be submitted to the Division <br />in writing within thirty days of the first publication in the The Daily Sentinel.
