incorporated into the applicant's permit with the approval of TR -68. Based on the observation <br />made during the inspection, the area is stable with some vegetation established and no erosion <br />features were observed. The area is being used as a storage area for the Kokopelli Farm fruit <br />stand. In accordance with Rule 3.02.3(2)(c), it appears the approved post -mine land use for this <br />parcel has substantially commenced and is likely to be achieved. <br />Hydrology - Suspended Solids Demonstration <br />Rule 4.05.2 states that sedimentation ponds and other treatment facilities for surface drainage <br />from the disturbed area shall be maintained until removal is authorized by the Division and the <br />disturbed area has been revegetated and stabilized, the untreated drainage from the disturbed <br />area ceases to contribute additional suspended solids above natural conditions, and the quality <br />of untreated drainage from the disturbed area meets the State and Federal water quality standard <br />requirements applicable after the sedimentation ponds and treatment facilities are removed, if <br />any, for receiving streams. Snowcap Coal Company has demonstrated that the untreated <br />drainage from the South Portal (Roadside Refuse Disposal and Borrow Areas), North Portal, <br />CRDA-1 and 2, and from the North Decline disturbed areas will contribute fewer suspended <br />solids to streamflow or runoff outside the permit area than untreated drainage from the natural <br />surrounding premising area. This was accomplished by a soil loss comparison between these <br />disturbed locations and corresponding non -disturbed reference areas using the Universal Soil <br />Loss Equation. SCC also provided an appropriate demonstration that the quality of untreated <br />drainage from these disturbed areas meets the State and Federal water quality standard <br />requirements applicable after the sedimentation ponds and treatment facilities are removed, if <br />any, for receiving streams. All of the sediment ponds requested for bond release with SL -09 <br />have met the requirements for removal, and demonstrations supporting their removal have been <br />incorporated into the permit in Appendix 14-12 and 14-13 of the Roadside Mine Permit with <br />Permit Revision No. 5 and Technical Revision No. 61. <br />SCC provided a soil loss demonstration in Tab 9 of the SL -09 bond release application for the <br />bond release areas, with the exception of Pond 8 (Area #7) as vegetation establishment is not <br />required for this area due to its approved industrial/commercial post -mine land use. The <br />demonstration utilizes the Universal Soil Loss Equation (LISLE) to demonstrate the reclaimed <br />parcels do not contribute suspended solids to the stream flow or runoff outside the permit area <br />in excess of adjacent un -affected areas. SCC submitted small subset figure maps of the bond <br />release areas. For each area evaluated, transects were drawn within the bond release areas and <br />adjacent undisturbed areas. SCC used the information drawn from these transects, such as slope <br />length and the vegetation cover data, along with regional climate information to obtain the <br />variables to input into the USLE. These variables were plugged into the USLE to ascertain the <br />soil loss in tons/acre/year for each parcel and their respective un -affected reclaimed area. For <br />each area evaluated, the reclaimed area was demonstrated to lose less sediment per year than <br />the adjacent undisturbed area (Tab 9 of the SL -09 application). The Division reviewed the <br />variables used to make this demonstration and the results and found them to be adequate. <br />All of the bond release areas were observed during the October 6, 2016 bond release inspection. <br />The bond release areas were stable and erosional features were not observed.
