<br /> <br /> <br />Notice of Proposed Decision <br /> <br /> <br />The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to <br />partially approve Bond Release Application No. 9 (SL-9) for the Roadside Portals, Permit No. C- <br />1981-041. The underground operation is operated by Snowcap Coal Company, Inc under the <br />provisions of the Colorado Surface Coal Mining Reclamation Act of 1979. The bond release <br />application was submitted by Snowcap Coal Company, Inc on August 15, 2016. This proposed <br />decision will release the applicant from Phase II liability on 13.1 acres and from Phase III liability <br />on 9.6 acres. Also, the proposed decis ion will terminate Division jurisdiction on 0.2 acres of <br />undisturbed land overlying underground workings. The specific areas to which this bond release <br />request applies is included within the Permit Boundary and are located as follows: <br /> <br />T10S, R98W, 6th P. M.: <br />Section 27: Portions of S1/2, SW1/4 <br />Section 28: Portions of SE1/4 <br />Section 34: Portions of SW1/4 and portions of NE1/4, NE1/4 <br /> <br />With the approval of SL-09 application, the Division proposes to release $97,202.20 of financial <br />liability. A copy of the SL-09 bond release application and the Division’s Proposed Decision and <br />Findings of Compliance document for the SL-09 application is available for public inspection at <br />the Mesa County Clerk and Recorder’s office, 200 S. Spruce, Grand Junction, CO . The affected <br />area is located in Mesa County, approximately 5 miles North of Palisade, Colorado. <br /> <br />Copies of the proposed decision are available for review at the Colorado Division of Reclamation, <br />Mining and Safety office, 1313 Sherman Street, Room 215, Denver, Colorado 80203, and on the <br />Division’s website at <br />http://mining.state.co.us/Reports/MiningData/Pages/ImagedDocumentData.aspx. Requests for a hearing must be made in writing within <br />thirty (30) days of the first publication of this notice, and shall state with reasonable specif icity the <br />reasons for the request and objections to the proposed decision. <br />
