lqm <br /> RESOLUTION NO. 11-6-16 n <br /> Series of 2016 C(DPY <br /> A RESOLUTION BEFORE THE CITY OF STERLING, LOGAN COUNTY, COLORADO, <br /> AUTHORIZING THE ENGAGEMENT OF THE LAW FIRM OF WHITE AND JANKOWSKI, LLP <br /> AND THE ENGINEERING FIRM OF BISHOP-BROGDEN ASSOCIATES, INC. TO PERFORM <br /> SERVICES FOR A GRAVEL POND AUGMENTATION PROJECT RELATING TO A <br /> PROPOSED RECREATIONAL POND TO BE CREATED FROM TWO PONDS PRESENTLY <br /> LOCATED ON CITY-OWNED LAND, DEFINED AS THE ROTHE GRAVEL PIT POND <br /> AUGMENTATION PROJECT; AND APPROPRIATING THE NECESSARY FUNDS. <br /> Introduced by Councilmember McCarty <br /> WHEREAS, the City purchased property from Rothe H2O LLC, on which is located a <br /> gravel pit with two ponds; and <br /> WHEREAS, the City wishes to pursue a project of converting the two ponds into one <br /> pond for youth fishing activities; and <br /> WHEREAS, the proposed project would require the leasing of water for the evaporation <br /> replacement requirements necessary to operate the planned pond, estimated to be <br /> approximately $1,500.00 annually; and <br /> WHEREAS, the proposed project will require the filing of appropriate supplemental <br /> proceedings with the Water Court, and the negotiation and preparation of a water lease <br /> agreement for acquisition of water for the evaporation replacement requirements, for which the <br /> services of the City's water attorneys, White & Jankowski LLP, will be needed, the cost of which <br /> is estimated to be $11,500.00, if there is no heavy opposition to the Water Court supplemental <br /> proceedings; and <br /> WHEREAS, the proposed project will require the determination of water demands, <br /> finding of replacement supply, development of augmentation plan operations and accounting, <br /> and preparation of a preliminary engineering report, and assistance with the supplemental <br /> proceedings in the Water Court, for which the services of the City's water engineers, Bishop- <br /> Brogden Associates, Inc., will be needed, the cost of which is estimated to be $15,000.00 if <br /> there is no heavy opposition to the Water Court supplemental proceedings; and <br /> WHEREAS, pursuant to Sec. 5-12 of the City Charter, the above appropriation in the <br /> amount of $26,500.00 is recommended by the City Manager and hereby certified to by the <br /> Director of Finance that there are sufficient funds in the Conservation Trust Fund to meet such <br /> appropriation. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> STERLING, COLORADO that: <br /> 1. The Mayor is authorized to execute the appropriate agreement or letter of <br /> engagement with the firm of White & Jankowski LLP for the services and cost as outlined <br /> hereinabove, upon approval as to form by the City Attorney. <br />
