COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />November 17, 2016 <br />La Plata County Commissioners <br />County Commissioners <br />1101 E. 2nd Ave/ <br />Durango, CO 80301-5155 <br />Re: Carbon Junction Mine (Permit No. C-1992-080) <br />Bond Release Application No. 5 (SL -5) <br />Dear La Plata County Commissioners: <br />This letter, as required by Rule 3.03.2(5)(a) of the Rules and Regulations of the Colorado Mined <br />Land Reclamation Board for Coal Mining, is to inform you that the Division of Reclamation, <br />Mining and Safety has issued a proposed decision to approve Bond Release Application No. 5 <br />for the Carbon Junction Mine. This decision will be published in the Durango Herald as soon as <br />possible. Publication of the notice initiates a thirty (30) day public comment period. If, within <br />thirty days, there are no requests for an adjudicatory hearing, the decision will become final. <br />The SL -05 Phase III application proposes final bond and liability release for the reclaimed <br />Carbon Junction Mine. If approved in its entirety, SL -05 would terminate jurisdiction of this <br />mine by the Division. This decision constitutes a full release of reclamation liability for the <br />Carbon Junction Mine. Pursuant to Rule 3.03.3(1), the Division is proposing to terminate its <br />jurisdiction over this entire coal mining operation. <br />As an interested party, you have the right to an adjudicatory hearing as outlined under Rule <br />3.03.2(6) of the Rules and Regulations. The request for an adjudicatory hearing must be written <br />and state with specificity the reasons why the hearing is requested. The request must be received <br />within thirty days of the first publication of the proposed decision in the Durango Herald. <br />Copies of the proposed decision and findings are available for review at the Division office at the <br />above address and on the Division's website at <br />http://mining.state.co.us/Reports/MiningData/Pa esg /ImagedDocumentData.aspx.
