Hickenlooper, Governor | Mike King, Executive Director | Virginia Brannon, Director <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />RE: Peabody Sage Creek Mine (PSCM); C-2009-087 <br /> 3Q 2016 Sediment Pond Inspection Report and Annual Certification Review <br /> <br />Dear Mr. Watterson: <br /> <br />The Colorado Division of Reclamation, Mining, and Safety (Division) has reviewed the above reference <br />report submitted in ac cordance with Rule 4.05.9(14), (15) and (17). The submittal included inspection <br />report forms for Pond 002, Pond 003, Pond 004, Spill Control Pond #2, PECOCO Pond, Lower Sump, <br />Truck Wash Settling Pond, Upper Sump, Portal Sump #1 and Portal Sump #2. Inspections appear to have <br />been done by Jason Harden with WWC Engineering on August 1, 2016. The submittal was certified by <br />Michael Berdine on October 28, 2016. The report appears to be in general compliance with any <br />exceptions noted below: <br /> <br />The annual impoundment inspection reports are required to include the information requir ed by Rule <br />4.05.9(15). The report forms for each impoundment includes a checklist regarding erosion, instability, <br />structural weaknesses and items that may be considered hazardous. Spillway and decant systems are <br />inspected, however the monitoring instrumentation (flumes/weirs) are not discussed. Other aspects <br />affecting structural stability and items that may require maintenance are discussed. <br /> <br />For all of the impoundments , in accordance with Rule 4.05.9(15), the report is required to discuss : <br /> (b) Existing and required monitoring procedures and instrumentation. <br />(c) The depth and elevation of any impounded waters at the time of the certified report. <br />(e) Existing storage capacity of the impoundment. <br />The inspection report forms for the impoundments do not supply this required info rmation. For <br />the next quarterly impoundment inspection report required by Rule 4.05.9(17), please supply the <br />information cited above . <br /> <br />The following maintenance items were noted: <br /> <br />Pond 003, small animal burrows were noted on the top of the dam. Please repair these animal burrows. <br /> <br />Pond 004, it was noted that all water was being discharged out of the old underdrain pipe.
