its operations. Applicant shall maintain such structure in good operating condition.
B. In the alternative the Applicant will• permit its water
entitlement to remain in the Fountain Mutual Ditch and flow into the Little
Johnson Reservoir to recharge and replace depletion to the aquifer and Fountain
River caused by its out of priority pumping. If Little Johnson Reservoir is used for
recharge, depletion credits will be reduced by 16%. The 16% figure used to reduce YA
depletion credits will be subject to adjustment if future engineering studies develop
a different percentage factor for other users of the Little Johnson Reservoir site
for recharge. The average percentage reduction factor applied to all other users in
each year shall then be substituted for the 16% factor.
4. That the calculations for depletions caused by the pumping of the
Applicant's wells is directly related to the production of its plant for the washing of
gravel and concrete manufacturing purposes. That the Applicant will report
(monthly the production of gravel in tons and the monthly production of concrete
from its Ready Mix operation in cubic yards by application of the Formula provided
herein will replace the depletions calculated pursuant to said Formula. The
Applicant will furnish these reports to the Water Commissioner of Water District
No. 10 and to Wheeeler and Associates on a monthly basis on or before the loth day I 1 cy
of the following month. The replacement water to be provided in each month shall
be that amount required under the Formula to cover depletions as a result of c
production shown for the preceeding month. The depletion credit allowance for
Fountain Mutual Water shall be the percentage indicated in the formula as
1I
hereinafter provided.
5. The Formula to be used to calculate monthly Transit Mix _
depletions and credit percentages for Fountain Mutual Water owned by the
Applicant and represented by 104 shares of Fountian Mutual Stock are as follows,
to-wit:
Monthly Depletion (D)= .052 P+ 0.21 A + 0.092R
Where P =previous month's production in thousands of tons
Where R = previous month's Ready Mix production in thousands of
cubic yards
A = Any ponds use%; iii or resulting from the Transit Mix operation
in acres
(1.66 unless otherwise determined)
-3-
