MINING PLAN <br /> there would be no need to consider the effects of mining on that program. In the event the <br /> remediation program continues well beyond the expected three to five year completion, then a formal <br /> agreement would be sought and provided to the Division and the MLRB prior to mining the <br /> J Property. <br /> OTHER CHANGES TO THE EXISTING MINING PLAN <br /> AND FUTURE EVENTS THAT MAY AFFECT <br /> THIS OPERATION <br /> (This has been imported,in part,from the Little Johnson Amendment. <br /> It is presented here to clarify and update issues discussed in that amendment.) <br /> Removal of the Processing Plant from the Reclamation Permit. In the Little Johnson <br /> Amendment, the fact that the processing plant originally expected to be relocated to the east side of <br /> Academy Boulevard was addressed. That relocation was removed from the mining plan. In 2006 it <br /> was determined that the processing plant did not actually need to be a part of the permit and was <br /> removed leaving about 37 acres of land permitted on the west side of Academy. No further action <br /> need be taken on this matter. This matter is included here simply to make note of these actions in the <br /> past and include these changes in this permit document. <br /> Possible Reservoir Lake: In the Little Johnson Amendment it was indicated that a <br /> reservoir was being considered for the southern end of the pit as well as in the Little Johnson <br /> Reservoir area. After further study by the party who desired to use the land for this purpose, those <br /> plans have been set aside for now due to excessive costs in constructing and sealing a site. This <br /> option might return in the future, but for now there are o plans o construct a reservoir as indicated <br /> in prior discussions. <br /> Possible New Highway to Colorado Springs Airport: In the Little Johnson Amendment, <br /> mention was made of a highway plan being developed to connect Academy Boulevard with the <br /> airport. That was simply under consideration with a very preliminary design at that time. This will <br /> now become a reality. For details as to how this project with integrate with the Daniels Sand Pit, <br /> please refer to a later section in this exhibit. <br /> SAND EXTRACTION ALONG ACADEMY BOULEVARD: In the 1992/1993 amendment, <br /> Phase 6e was included and anticipated the extraction of the sand down to an elevation of about 10 <br /> feet above the elevation of Academy Boulevard. This was to be the last area mined and it was <br /> expected that keeping at least some of the high berm along the highway would provide a.good visual <br /> Daniels Sand Pit Amendment (2008) Exhibit D Page 19 of 28 <br />
