This decision will
become final at the close of the thirty (30) day public comment period, which commences with
the initial publication in the Durango Herald. A copy of the proposed decision and written
findings is enclosed.

The SL-05 Phase III application proposes final bond and liability release for the reclaimed
Carbon Junction Mine. If approved in its entirety, SL-05 would terminate jurisdiction of this
mine by the Division. This decision constitutes a full release of reclamation liability for the
Carbon Junction Mine. Pursuant to Rule 3.03.3(1), the Division is proposing to terminate its
jurisdiction over this entire coal mining operation.

As provided by Rule 3.03.2(6), should you object to the Division's proposed decision, you may
request an adjudicatory hearing.

If you have questions or need of additional information, please contact me.
