Box 670 <br />Hayden, CO 81639 <br />November 15, 2016, 2016 <br />Re: Proposed Hayden Gulch Interim Stabilization Measures <br />Dear Mr. Nettleton: <br />In response to your letter, dated November 8, 2016, regarding mitigation measures Hayden <br />Gulch Terminal, LLC proposes to conduct on the two areas of disturbance that were subject of <br />NOV-CV-2016-002. <br />HGT, LLC commits to removing and disposing of remaining materials and debris at the Peabody <br />owned property in Township 6N, Range 88W, Section 10. Tilling and reseeding of this area will <br />occur in the spring of 2017. The Division is in concurrence with this commitment. <br />Within the State Trust Lands in Township 6N, Range 88W, Section 14, HGT, LLC commits to <br />cleaning up any remaining material and debris, scarifying, if necessary, seeding with the <br />approved dry -land pasture seed mix, and repair fences that were damaged during rail line <br />reclamation activities. HGT, LLC stated that this work would be conducted within 30 days of <br />the November 8, 2016 letter.
