Cazier <br /> Environmental Protection Specialist <br /> Colorado Division of Reclamation,Mining and Safety <br /> 1313 Sherman Street,Room 215 <br /> Denver, Colorado 80203 <br /> v <br /> Ref:Permit No.M-1980-244; Cripple Creek& Victor Gold Minine Company("CC&V");Cresson <br /> Proiect•-Transmittal of State of Colorado Division of Reclamation Minin and Safe (DRMS) <br /> Application for Amendment 11Application for Amendment 11 ——Party <br /> Dear Mr. Cazier, <br /> As stated in previous correspondence to DRMS and reiterated again during yesterday's phone conference <br /> call between Teller County, CC&V and DRMS,Teller County is prepared to process both the <br /> Amendment of the Official Zone District Map application and the Amendment 11 application pursuant to <br /> procedures outlined in Appendix A, Cripple Creek Mining Overlay District(CCMOD)of the Teller <br /> County Land Use Regulations. <br /> Section 34-32-109(6)C.R.S.requires a mining operator to be responsible for assuring that the mining <br /> operation and the post-mining land use comply with local land use regulations and any master plan for <br /> extraction adopted pursuant to Section 34-1-304, C.R.S. The requirements of Teller County as outlined in <br /> the CCMOD Appendix should not be construed as an objection or non-concurrence of Amendment 11, it <br /> is merely the method which allows us to bring the CC&V application through the public process to the <br /> Board of County Commissioners for the ultimate decision and comply with the provisions outlined in <br /> Section 34-32-109(6)C.R.S. Both the Amendment of the Official Zone District Map request and the <br /> Amendment 11 request will need to pass through the Teller County Planning Commission for a <br /> recommendation and then the Board of County Commissioners for a decision. <br /> There is no intent on behalf of Teller County to obstruct or slow the DRMS process by outlining our <br /> statutory responsibility and Land Use requirements as part of our formal comments to the DRMS <br /> application. <br /> Teller County is amiable to a statement that conditions any DRMS approval at the December 2016 <br /> hearing, contingent upon the successful completion of both required Teller County actions [Amendment <br /> of the Official Zone District Map and the approval of Amendment 11 at the County Level],with the <br />
