Dear Mr. Hays:
Thank you for your review of the above-referenced Regular 112 Reclamation Permit application. As the
Applicant/Operator, Brannan Sand and Gravel is committed to ensuring that the proposed Valley's Edge
Resource complies with all regulatory requirements. Accordingly, our response to each point in your October
19, 2016, adequacy review letter is addressed, by number, below.
1. As required by Rule 1.6.2(d)and 1.6.5(2), please submit proof of publication in a newspaper of general
circulation in the locality of the proposed mining operation.
Public notice of the Regular 112 permit was published in the Fort Lupton Press on September 7, 14,21 and 28.
Proof of publication, in the form of an affidavit executed by the local newspaper, is attached.
2. As required by Rule 1.6.2(e), please submit proof of the notice to all owners of record of surface and
mineral rights of the affected land and the owners of record of all land surface within 200 feet of the
boundary of the affected land within 200 feet of the boundary of the affected land. Proof of notice
may be return receipts of a Certified Mailing or by proof of personal service.
See Attachments 2 and 3.
All owners of surface and mineral rights in the area of the affected lands and the owners of record of all land
surface within 200 feet of the boundary of the affected land, with the exception of Mr.Joseph and Mrs. Carrie
Sack,were mailed notice immediately after first publication,via United States Post Office Certified Mail (see
attached USPS sender receipts, and USPS delivery receipts/returned envelopes or copies of copies of
envelopes for items returned to sender).
During preparation of this DRMS Adequacy Review Response, it was determined that the Applicant had no
proof of public notice mailings to Mr.Joseph and Mrs. Carrie Sack. Proof of notice of mailing from November
2, 2016, is attached.
3. The Division received comments from the Colorado Division of Water Resources and Army Corps of
Engineers. The letters are attached for review. Please address the comments noted in the letters and
make any changes to the application as needed.
