October 31, 2016 <br /> Mr. Peter Hays <br /> Colorado Division of Reclamation Mining&Safety <br /> 1313 Sherman Dr., Room 215 <br /> Denver, CO 80203 <br /> Re:Technical Revision for the South Portion of S&H Mine Permit Area (DRMS Permit M-2000-158) <br /> Dear Peter: <br /> As discussed during the conference call on October 3, 2016,Scout Investments, Inc. (Scout) proposes to <br /> revise the reclamation plan for the southern portion of the S&H Mine,which includes portions of the <br /> property now owned by the City of Aurora (Aurora).Scout purchased the S&H Mine,the rights to the <br /> mining permit, and the on-site minerals and materials from Gilcrest Reservoir, LLC("Gilcrest) in 2015. In <br /> separate transactions that year, United Milliken Reservoir Enterprise, LLC(UMRE) and Aurora purchased <br /> the north and south surface parcels, respectively,from Gilcrest. As part of those transactions,Scout <br /> acceded to a three-year period during which it agreed to reclaim the area encompassing the existing <br /> wash pit, conveyors and related equipment, and material stockpiles(the "Aurora Pit"). Aurora retained <br /> the obligation to maintain weed control on its property. In summary, no further mining is planned for <br /> this property by Scout and Scout proposes to backfill and revegetate the Aurora Pit to its pre-mining <br /> grade, remove all equipment from the site and return the land to its post mining land use of rangeland. <br /> As shown on the attached revised Reclamation Plan, a significant portion of the Aurora owned property <br /> was not disturbed. Cell B,which was originally planned as a large mined cell with embankments was <br /> only partially opened. Rather than achieve final reclamation contours of a mine pit (water storage <br /> facility)and leave this cell open, Scout proposes to backfill the pit to pre-mining grade and change the <br /> post mining land use for the open water pond and processing areas from developed resource to <br /> rangeland. In addition to backfilling the Aurora Pit,all processing equipment will be removed from the <br /> site.All areas disturbed to date or by the proposed reclamation will be prepared with topsoil and <br /> revegetated. Scout plans on utilizing the existing on-site sand stockpiles to backfill the Aurora Pit. Any <br /> available stockpiled topsoil will be used in the revegetation with the remaining topsoil brought in from <br /> an offsite source as needed. <br /> Scout will adhere to the revegetation criteria established in the January 18, 2011 adequacy review <br /> comment responses from Civil Resources(reference page 5, item 19) including 6-inch topsoil placement <br /> and drill seeding with the following approved seed mix: <br />
