Box 2905 <br />Durango, Colorado 81302 <br />Dear Sirs: <br />I am the owner of the surface of the land on which is located the <br />surface facilities of the King Coal Mine, operated by National <br />King Coal, Inc. These Facilities include various buildings such <br />as the sales office, lab building, pump houses and shop. <br />I would have numerous uses for these buildings in my ranching and <br />agriculture endeavors, and have expressed to National King Coal, <br />Inc. my intentions to acquire the buildings as well as property <br />owned by them that is contiguous to my land, upon cessation of <br />mining. <br />Therefore, when the King Coal Mine operation is completed, I wish <br />for these buildings to remain intact and not to be removed. I <br />understand that the government reclamation authorities will <br />approve a reclamation plan for the King Coal Mine which calls for <br />leaving these buildings in place upon the request I have made as <br />owner of the land surface. If plans are considered in the future <br />to remove these buildings, please take notice that no such action <br />should be taken without my approval. <br />I will expect that the preexisting access road into the site will <br />be left intact for transporting livestock to and from the site.
