Summary
The Review Process
WFC submitted an application for a permit revision on April 21, 2016. The application was
deemed complete on April 29, 2016. The applicant's public notice was published in the San
Miguel Basin Forum for four consecutive weeks beginning on May 5, 2016. The comment period
ended on June 25, 2016.
WFC is proposing to remove the East and Northwest haul roads, install the North haul road, install
the South access road, revise the postmining topography, revise the post mining land use
configuration, update irrigation designs and update culvert location and sizes.
The Division received two comments during the comment period. In a letter dated May 9, 2016,
the CHS made a finding of `no historic properties affected.' In a letter dated May 31, 2106, CPW
stated they do `not foresee any significant negative impacts to wildlife.'
Description of the Environment
The New Horizon North (NHN) Mine permit area encompasses a total of 328.7 acres in western
Montrose County, three miles northwest of the town of Nucla. The NHN Mine facilities and
operations areas occupy one-half square mile of land that is bounded by Montrose County Z Road
on the North, AA Road on the South, 26.50 Road on the East and 26.00 Road on the West.
The NHN mining operations area is divided into three separate parcels, with three individual
landowners. The southern parcel, owned by Garvey, comprises 160 acres (WI/2 and E'/z of the
SW'/4 Section 25). To the north of Garvey is the 80 -acre Meehan parcel (S%z NWS/4 Section 25).
The northern most parcel (N/2NW/4 Section 25), also 80 acres in size, is owned by Glasier.
Land Use — Section 2.04.3 of the permit
The Garvey property is dominated by grazingland-reclamation across its southern extent. This
area was mined and reclaimed to dryland pasture by Peabody/WFC as the Nucla Mine, C-1981-
008. There are some minor inclusions of subirrigated land, where irrigation water has been
allowed to flow across the surface. The northeast corner was an area of grazingland—sagebrush.
The contour of this site lies above the elevation of the Second Park Lateral of the Colorado
Cooperative Company (CCC) Ditch, with the result that the area has never been irrigated. The
northwestern portion consisted largely of the intensively managed irrigated pasture land use, and
some irrigated pasture.
The Meehan property is bisected by "Meehan Draw", which flows from east to west across the
property. South of Meehan Draw, the majority of the area falls within the irrigated pasture land
use category, due to its proximity to the Second Park Lateral Ditch located uphill to the south.
Meehan's land to the north of the Draw has not been improved, and is classified as grazingland
sagebrush. Land use within Meehan Draw is classified as grazingland — subirrigated.
3
