Introduction <br />This document is the decision package prepared by the Colorado Division of Reclamation, Mining <br />and Safety (the Division) for the New Horizon North Mine. This document includes: 1) the <br />proposed decision to approve the permit revision application; 2) a summary which includes a <br />history of the review of the permit application, a description of the environment affected by the <br />operation and a description of the mining and reclamation plan; and 3) the written findings of <br />compliance the Division has made as required by the Colorado Surface Coal Mining Reclamation <br />Act. Detailed information concerning the findings of compliance can be found in the Regulations <br />of the Colorado Mined Land Reclamation Board for Coal Mining. <br />The Division received an application for a permit revision (PR -1) to conduct surface coal mining <br />and reclamation operations at the New Horizon North Mine. WFC is proposing to remove the East <br />and Northwest haul roads, install the North haul road, install the South access road, revise the <br />postmining topography, revise the post mining land use configuration, update irrigation designs <br />and update culvert location and sizes. The application was submitted by Western Fuels -Colorado, <br />LLC (WFC) on April 21, 2016. During the review of PR -1, WFC submitted a request for a <br />succession of operator (SO -1) on July 18, 2016. SO -1 requested to change the name of the operator <br />from Western Fuels -Colorado to Elk Ridge Mining and Reclamation, LLC (ERMR). The Division <br />issued a proposed decision to approve SO -1 on October 3, 2016. ERMR will operate the New <br />Horizon North Mine but references to WFC will be used in this findings document for historical <br />purposes. The mine is located on private lands within Montrose County, Colorado. The legal <br />description of the lands included within the permit area is: <br />Township 47 North, Range 16 West, New Mexico Principal Meridian <br />Section 25: W 1/2 <br />Section 36: Portions of the NW 1/4 and the NW 1/4 NW 1/4 SW 1/4 <br />1 <br />
