by PR -1. It was determined that Irrigated Pasture, Intensely Managed Irrigated Pasture <br />and Dryland Pasture meet the requirements of Rule 4.16 for the permit area (2.07.6(2)(1)). <br />14. The Division finds that no specific approvals required under Rule 4 are necessary for this <br />mine plan. <br />15. The Division finds that the activities by the applicant would not affect the continued <br />existence of endangered or threatened species or result in the destruction or adverse <br />modification of their critical habitats (2.07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As of <br />this time, Elk Ridge Mining and Reclamation, LLC, the present operator is current in the <br />payment of reclamation fees required by 30 CFR Chapter VII, subchapter R (2.07.6(2)(0)). <br />Section B - Rule 4 <br />I. Roads - Rule 4.03 <br />A. Haul Roads <br />Haul Roads are described in Section 2.05.3(3) and detailed on Map 2.05.3(3)-3 of <br />the permit application. Permit revision PR -1 is proposing to add the North Haul <br />Road. The two haul roads (the existing West Haul Road and proposed North Haul <br />Road), ranging in width from 30 to 100 feet, are located entirely within the bounds <br />of the disturbed area in accordance with 4.05.2(4). PR -1 is also proposing a new <br />culvert associated with proposed North Haul Road to be installed in Meehan <br />Draw. Drainage from the haul roads is directed to sedimentation ponds within the <br />permit boundary using a system of ditches and culverts, thus preventing additional <br />contributions of suspended solids to streamflow or to runoff outside the permit area. <br />The roads are surfaced with gravel and prudent dust control practices are used as <br />necessary. No haul roads will be retained as permanent features. <br />Permit revision PR -1 is also proposing to remove the East and Northwest Haul <br />Roads from the permit, as these roads were not constructed. <br />B. Access Roads <br />Permit revision PR -1 is proposing to add the South Access Road. The South Access <br />Road is described in Section 2.05.3(3) and detailed on Map 2.05.3(3)-3 of the permit <br />application. The road ranges in width from 20 to 60 feet and is located entirely <br />within the bounds of the disturbed area in accordance with 4.05.2(4) and will not <br />be used for the transport of coal, spoil or coal mine waste. Drainage from the <br />access road is directed to sedimentation ponds within the permit boundary using a <br />system of ditches and culverts, thus preventing additional contributions of <br />suspended solids to streamflow or to runoff outside the permit area.
